ARTICLE 1 | GENERAL INFORMATION
- Walden, with VAT number BE0876098951, is referred to in these terms and conditions as Peak One bv.
- Visitors are all natural persons and legal entities who use the facilities as described.
- Active visitors are visitors who actually use the sports facilities. All visitors present may be registered in our member database.
ARTICLE 2 | SAFETY
- Active visitors are required to inform themselves about the house rules, safety regulations, and general terms and conditions of Peak One bv before exercising. These are available at the reception desk and near the bouldering walls. If in doubt about these rules or how to comply with them, visitors should discuss this with staff present.
- Active visitors only use the facilities offered by Peak One bv if they are certain that their physical condition and fitness allow this. Peak One bv makes no statement about this.
- Active visitors treat Peak One bv’s infrastructure carefully and bear responsibility for their own safety and that of other (active) visitors.
- Active visitors adhere to the bouldering rules.
ARTICLE 3 | ACCESS
- On their first visit, every active visitor registers at the reception desk and thereby accepts the house rules, safety rules, and general terms and conditions.
- Active visitors must report to the reception desk before each visit.
- Ten-entry cards and subscriptions are strictly personal. A ten-entry card is valid for one year from the date of purchase. Unused entries expire. Customers with a subscription or ten-entry card must always scan it before entering the changing rooms or climbing hall.
Forgot your card? Speak to the reception staff. “Forgetting” to scan a ten-entry card is considered fraud. In case of any form of fraud or abuse, the card will be cancelled without any form of refund. The cardholder will be permanently and definitively denied access to the hall. - You can pause your subscription in case of injury or a medical procedure, but only with a doctor’s note. This can be done for a minimum of 6 weeks and takes effect from when we receive your doctor’s note.
- Children under 6 years old only have access to the consumption area and may not enter the bouldering wall, mats, or training area.
- Active visitors between 6 and 12 years old may only enter the bouldering facilities under direct supervision of an adult guardian. During lessons organised by Peak One bv or a recognised partner, the instructor acts as guardian. However, parents must accept the house rules, safety rules, and general terms and conditions.
- Independent bouldering is permitted from age 12.
- The fitness room and fitness equipment may only be used by visitors aged 18 and over. Operation and use of the Kilterboard is reserved for visitors aged 18 and over.
- Visitors must be able to identify themselves at all times.
- Peak One bv reserves the right to adjust opening hours without prior notice.
ARTICLE 4 | REMOVAL AND EXCLUSION
- Peak One bv staff present have the right to immediately request visitors who do not comply with the rules to leave the premises. In that case, no refund of entrance fees will be given.
- In case of repeated violations, Peak One bv’s management may decide to completely revoke a visitor’s access rights, without refund of entrance or subscription fees. This will also be the case with any form of fraud, deception, or theft.
ARTICLE 5 | LIABILITY
- Peak One bv is not liable for loss, theft, or damage to personal belongings of visitors, both inside and around the premises. This also applies to damage to or caused by visitors as a result of their physical condition or their own bouldering materials.
- Damage resulting from violation of the general terms and conditions or safety rules cannot lead to liability of Peak One bv.
- Peak One bv staff are not responsible for supervising the safety of visitors. However, instructions from staff must be followed.
- Peak One bv can be held liable for damage resulting from defects in the offered infrastructure, provided it is used correctly.
- Services in the form of instruction are provided by Peak One bv. Damage caused by actions or negligence of staff or partners can only be claimed in case of intent or gross negligence by subordinates.
- If Peak One bv is liable, this is limited to compensation within the insurance coverage. If the insurer does not pay out, liability is limited to a maximum of ā¬1,000 per event.
- You are not automatically insured for sports accidents when climbing at Walden. If you wish, you can take out insurance yourself with, for example, the KBF or another external insurer.
ARTICLE 6 | APPLICABLE GENERAL TERMS AND CONDITIONS
These general terms and conditions come into effect from the date stated upon publication. Peak One bv may change these terms and conditions at any time. Changed terms and conditions apply immediately and do not affect previously acquired rights of visitors, except for renewed memberships or after the end of a membership period.
ARTICLE 7 | PRIVACY
Photos and videos may be taken at Walden to capture and share the atmosphere in the hall or during events, for example on our website or social media. If you do not wish to be photographed or filmed, please inform the photographer or a person in charge and avoid areas where photos are being taken. Would you like a published photo removed? Please contact us.
ARTICLE 8 | LESSONS
If you are unable to attend the complete lesson series for medical reasons, you can transfer your registration to someone else or postpone it to a following series, provided you present a doctor’s certificate.
Moving or making up an individual lesson is not possible. No refund of the registration fee will be given upon cancellation.
